This website, thebirdinginsights.com (the "Site"), is operated by The Birding Insights. Throughout the Site, the terms "we", "us", and "our" refer to The Birding Insights. We offer this Site, including all articles, resources, downloadable tools, newsletter, and other content available from the Site (collectively, the "Services"), to you, the user, conditioned upon your acceptance of all terms, conditions, and notices stated here.
By visiting the Site, subscribing to our newsletter, downloading our resources, or otherwise interacting with the Services, you agree to be bound by the following Terms of Service ("Terms"). These Terms apply to all users of the Site, including visitors, newsletter subscribers, and commenters.

While we draw on firsthand field experience in Patagonia and other locations, and verify bird taxonomy and place names against authoritative sources (including eBird, All About Birds, and the Cornell Lab of Ornithology), we make no guarantees about the accuracy, completeness, or timeliness of the information.
Bird species distributions, site access conditions, park regulations, trail conditions, border crossings, permit requirements, and weather can all change. Any reliance on the material on the Site is at your own risk. You are solely responsible for assessing your own safety, preparation, and legal compliance when planning or undertaking birding trips based on information from the Site.
We reserve the right to modify the contents of the Site at any time, but we have no obligation to update any information.
Section 4 — Newsletter and Downloadable Resources
We offer a free newsletter and free downloadable resources (such as checklists, guides, and planning tools). By subscribing or downloading, you consent to receiving emails from us. You may unsubscribe at any time using the link at the bottom of any email we send you.
The downloadable resources are provided for your personal, non-commercial use. You may not redistribute, republish, or resell our downloadable resources without written permission from us.

This includes, without limitation, any damages arising from your reliance on birding information, trip planning information, gear recommendations, or other content on the Site in connection with outdoor activities, travel, or purchases. You are solely responsible for your own safety and decisions.
Because some jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, in such jurisdictions our liability shall be limited to the maximum extent permitted by law.
Section 12 — Indemnification
You agree to indemnify, defend, and hold harmless The Birding Insights, its owner, affiliates, partners, agents, contractors, and service providers from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your breach of these Terms, your violation of any law, or your violation of the rights of a third party.
